1. Acceptance of Terms

By accessing, browsing, or using FaceSports ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site. These Terms apply to all visitors, registered users, and anyone else who accesses or uses FaceSports.

2. Eligibility

You must be at least 13 years of age to use FaceSports. By using this Site, you represent and warrant that you meet this age requirement. Users between the ages of 13 and 17 should have the consent of a parent or legal guardian. FaceSports does not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information, we will take steps to delete such information promptly.

3. User Accounts

To access certain features of FaceSports, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify FaceSports immediately of any unauthorized use of your account. FaceSports is not liable for any loss or damage arising from your failure to protect your account credentials.

4. User Conduct & Prohibited Content

By using FaceSports, you agree not to post, transmit, or share content that:

Is hateful, abusive, threatening, harassing, defamatory, or discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
Contains obscene, pornographic, or sexually explicit material
Promotes or facilitates illegal activity of any kind
Infringes upon the intellectual property rights of any third party
Contains spam, phishing attempts, or malicious links
Impersonates another person or entity
Is intentionally misleading or constitutes disinformation

5. User-Generated Content & Section 230 Notice

FaceSports is an interactive platform that hosts user-generated content. Opinions, arguments, debate posts, and all other content submitted by users are solely the responsibility of the individuals who posted them. FaceSports does not endorse, verify, or adopt any user-generated content as its own. Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), FaceSports is not liable for content posted by third-party users. By posting content on FaceSports, you grant the Site a non-exclusive, royalty-free, worldwide license to display your content on the platform for operational purposes. You retain all ownership rights to your original content.

6. Live Video Debates

FaceSports facilitates live video debates through a third-party service (Jitsi Meet). By participating in a live video debate, you consent to being seen and heard by other participants in real time. FaceSports is not responsible for recording, storing, or distributing video debate sessions unless explicitly stated. FaceSports reserves the right to terminate any live session where participants engage in harassment, threats, hate speech, or any conduct that violates these Terms. You participate in live video debates at your own risk.

7. Sports Betting Odds & Entertainment Disclaimer

Any betting odds, lines, or wagering information displayed on FaceSports is provided strictly for informational and entertainment purposes only. FaceSports does not accept bets, facilitate gambling transactions, or operate as a licensed sportsbook. Nothing displayed on this Site constitutes legal gambling advice. You must be 21 years of age or older and comply with all applicable laws in your jurisdiction before engaging in any real-money sports wagering through any third-party platform. Gamble responsibly. 9. Third-Party Services

FaceSports uses Firebase for authentication and data, Netlify for hosting, Stripe for payments, Cloudflare R2 for media, Jitsi Meet for video debates, ESPN APIs for sports data, Anthropic for AI, Resend for email, and Sentry for optional error monitoring. Each service has its own terms and privacy policy. FaceSports does not control its availability or conduct.

10. Intellectual Property

All original content, branding, design elements, logos, and source code created by or for FaceSports are the exclusive property of FaceSports and its owner. Unauthorized reproduction, distribution, modification, or commercial use of FaceSports content without prior written permission is strictly prohibited. Any trademarks, service marks, or logos of third-party organizations displayed on this Site remain the property of their respective owners.

11. Limitation of Liability

To the fullest extent permitted by applicable law, FaceSports and its owner shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Site, including but not limited to damages resulting from user-generated content, service interruptions, data loss, or conduct of other users. Your use of FaceSports is at your sole risk. The Site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

12. Account Suspension & Termination

FaceSports reserves the right to suspend, restrict, or permanently terminate any user account at any time, with or without notice, for any violation of these Terms or for any conduct deemed harmful to the platform or its community. Decisions regarding account termination are made at the sole discretion of FaceSports.

13. Modifications to Terms

FaceSports reserves the right to update or modify these Terms at any time. Changes will be indicated by an updated "Last updated" date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Oklahoma County, Oklahoma.

Privacy Policy

1. Introduction

FaceSports ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and protect your personal information when you use the FaceSports website located at facesports.com ("the Site"). By using FaceSports, you consent to the data practices described in this policy.

2. Information We Collect

a) Information you provide directly: When you register for an account, we collect your email address and display name. You may also optionally provide a profile photo or username. When you post arguments or engage in debates, that content is associated with your account.

b) Information collected automatically: We may collect certain technical information automatically, including your IP address, browser type, device type, operating system, and pages visited. This information is used for security, analytics, and to improve the Site.

c) User-generated content: Any debate arguments, predictions, votes, chats, direct messages, comments, or other content you submit is stored on our platform. Public content is visible to other users; private communications are limited to their participants and authorized FaceSports administrators for safety, moderation, dispute handling, and record integrity.

d) Account enforcement data: To enforce our Terms of Service and prevent abuse, we collect and retain a device fingerprint (a stable identifier derived from your browser's characteristics such as screen size, installed fonts, timezone, and browser version) and the most recent three IP addresses you use to access the Site. This data is generated client-side via the open-source FingerprintJS library and stored only in your account record. It is used solely to enforce restrictions against users who violate our Terms of Service and to prevent restriction evasion. We do not use this data for advertising, analytics, profiling, or any purpose unrelated to enforcement and platform integrity. Restriction records are retained for the duration of the active restriction plus 12 months for audit purposes, after which they are automatically purged. You may request access to or deletion of this data after the restriction period ends by contacting support@facesports.com.

e) Billing: Stripe processes purchases and returns transaction and subscription records to FaceSports. FaceSports does not receive or store full card numbers.

3. How We Use Your Information

We use your information to:

Create and manage your user account
Display your username and activity on the platform (leaderboard, arguments, votes)
Send transactional emails such as password resets or account notifications
Monitor and enforce our Terms of Service
Improve platform performance, security, and user experience
Comply with applicable legal obligations

We do not sell, rent, or trade your personal information to any third parties for marketing purposes.

4. Third-Party Services & Data Sharing

FaceSports uses the following third-party services that may process your data in accordance with their own privacy policies:

Firebase (Google LLC) — Used for user authentication and account management. Subject to Google's Privacy Policy.
Jitsi Meet — Used to facilitate live video debates. FaceSports does not record or store video sessions. Subject to Jitsi's Privacy Policy.
ESPN APIs — Used to retrieve publicly available sports scores and data. No personal data is shared with ESPN.
Anthropic — Used to power the AI Debate Coach feature. Debate prompts may be sent to Anthropic's API for processing. Subject to Anthropic's Privacy Policy.
Resend — Used to deliver transactional emails such as ban appeal notifications and decisions. Your email address may be transmitted to Resend for delivery purposes only. Subject to Resend's Privacy Policy.
FingerprintJS (open-source) — A browser-side library used to generate a device fingerprint for restriction enforcement. The library runs in your browser and does not transmit data to any third party; the resulting identifier is stored only in FaceSports' database.
Netlify — Used for website hosting and deployment. Subject to Netlify's Privacy Policy.
Stripe — Processes subscriptions, Wallet purchases, refunds, and billing-portal requests. Subject to Stripe's Privacy Policy.
Cloudflare R2 — Stores and delivers user-uploaded media. Subject to Cloudflare's Privacy Policy.
Sentry — Receives sanitized technical diagnostics for error monitoring when enabled. Subject to Sentry's Privacy Policy.

We may also disclose your information if required by law, court order, or government authority, or to protect the rights and safety of FaceSports, its users, or the public.

5. Cookies & Local Storage

FaceSports uses browser local storage and session storage to save your preferences, login state, and debate activity on your device. We do not use third-party tracking cookies for advertising purposes. By continuing to use FaceSports after dismissing our cookie notice, you consent to our use of local storage for these operational purposes.

6. Data Retention

We retain your account information and user-generated content for as long as your account remains active. To protect record integrity and support safety, moderation, disputes, and legal compliance, FaceSports keeps an administrator-only preservation copy when user-generated content is removed from public or participant-facing areas. These preserved records may include chats, direct messages, debate transcripts, arguments, predictions, Hot Takes, edits, and deletion details, and are accessible only to the two authorized administrator accounts. You may download a portable copy of your account data from Account & Security. If you request account deletion, a 30-day recovery period applies during which you may cancel the request. An active paid subscription must be canceled before the recovery period can begin. After the recovery period, we remove or anonymize personal information from active systems, subject to this restricted preservation record and retention required for billing, fraud prevention, safety, moderation, disputes, legal obligations, and backups. Valid legal deletion requests remain subject to applicable law.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

Access the personal information we hold about you
Request correction of inaccurate information
Request deletion of your account and associated data
Object to or restrict certain types of data processing
Withdraw your consent at any time (where processing is based on consent)

8. Children's Privacy (COPPA)

FaceSports is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information without parental consent, please contact us immediately and we will take prompt action to remove that information.

9. Security

We take reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

10. Debate & Chat Records

Debate & chat records. When you take part in a one-on-one debate or challenge, or post in a public chat room, your messages are stored and retained as part of FaceSports' record of sports debate. Authorized FaceSports administrators (limited to the site operators) may review these records for safety, moderation, and platform-integrity purposes, and may redact or remove content that violates our Terms of Service. Public takes and predictions are intended to be a lasting public record. You may request access to, or deletion of, your personal data by contacting us at the address provided below.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be reflected by an updated "Last updated" date at the top of this page. Your continued use of FaceSports after any changes constitutes your acceptance of the updated policy.

Refund & Cancellation Policy

1. Overview

FaceSports offers three kinds of paid features: the FaceSports Pro subscription, one-time Wallet top-ups, and pay-per-use AI debates and Face-Offs. This policy explains how cancellations and refunds work for each. By making a purchase on FaceSports you agree to this policy. Nothing here limits any non-waivable rights you may have under the consumer-protection laws of your jurisdiction.

2. FaceSports Pro Subscription

FaceSports Pro is a recurring subscription that renews automatically until cancelled. You can cancel anytime from your account’s billing portal, or by emailing us. Cancelling stops all future renewals and you keep Pro access through the end of the billing period you have already paid for. We do not provide prorated or partial-period refunds for time that has already elapsed on an active subscription. If you were charged in clear error (for example, a duplicate charge), contact us and we will correct it.

3. Wallet Top-Ups (Credits)

Credits are final. Wallet top-ups are non-refundable once purchased, except as described in Section 4 (Undelivered Services) or where required by law (Section 5). Credits do not expire — your wallet balance remains available to you. Credits have no cash value: they can be used only within FaceSports, are not redeemable for cash, cannot be withdrawn, and are not transferable between accounts, except where required by law. Top-ups are sold in fixed amounts shown at checkout, and you are charged only the amount you select.

4. Undelivered Services (Automatic Credit-Back)

We only want to charge you for features that actually work. If you are charged for a paid action that fails to be delivered — for example, a live Face-Off room that does not start — FaceSports automatically returns that charge to your wallet balance. No request is needed in the normal case. If you were charged for a feature you did not receive and do not see the credit returned, contact us (Section 6) and we will make it right.

5. Your Legal Rights

Nothing in this policy limits or waives any rights you have that cannot be limited or waived under the consumer-protection or other laws that apply to you. If the law where you live requires a refund or grants rights beyond what is described here, those laws apply and take precedence over this policy.

6. How to Request Help or a Refund

For billing questions, refund requests permitted under this policy, or a charge you believe was made in error, contact us at support@facesports.com. Please include the email address on your FaceSports account, the date and amount of the charge, and a short description of the issue (for a Face-Off that did not work, roughly when it happened). We aim to respond within 5 business days.

7. Chargebacks

If you believe a charge is wrong, please contact support@facesports.com first — we can usually resolve it faster than a bank dispute. Filing a chargeback without contacting us may result in a temporary hold on Wallet features or your account while the dispute is reviewed. Fraudulent or bad-faith chargebacks may lead to suspension of your account.

8. Changes to This Policy

We may update this Refund & Cancellation Policy from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated through the app or by email where appropriate.

Debate takes, comments, votes, and other material you submit remain associated with you, but by posting on FaceSports you grant FaceSports LLC a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that material for the purpose of operating, improving, and promoting the platform. You represent that you have the right to post any material you submit and that it does not infringe the rights of any third party.

5. Reporting Infringement

FaceSports respects the intellectual property rights of others and expects its users to do the same.
